The Performance Institute provides elective, non-emergency men's health services via telehealth. Our services are not designed to handle medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.

Telehealth consultations have inherent limitations compared to in-person care. By engaging our services, you acknowledge these limitations and agree that certain conditions may require in-person evaluation that we cannot provide.

4. Physician-Patient Relationship

A physician-patient relationship is established only after Dr. Michael has reviewed your information, conducted a consultation, and agreed to provide care. Submitting a contact form or inquiry does not establish a physician-patient relationship.

Dr. Michael retains full clinical discretion in all treatment decisions. Nothing in these terms limits his professional judgment or obligates him to prescribe any specific medication.

5. Membership and Payment

Our services are offered on a monthly membership basis at the rate disclosed at the time of enrollment. Your membership includes:

We are a cash-pay practice. We do not accept insurance. All fees are due at the time of service. You are responsible for all charges incurred under your membership.

6. Cancellation and Refunds

You may cancel your membership at any time by contacting us at info@mensperformancemd.com. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial months of service already rendered.

If medication has already been compounded and shipped, that cost is non-refundable. We reserve the right to discontinue your membership at any time for clinical, legal, or business reasons.

7. Prescription Medications

Medications prescribed through The Performance Institute are prescribed solely for your personal use based on your individual clinical evaluation. You agree:

Certain medications may be classified as controlled substances and are subject to applicable federal and state laws. Misuse of prescription medications is illegal and may result in immediate termination of services.

8. SMS Communications

By submitting our contact form or enrolling in our services, you consent to receive SMS messages from The Performance Institute for care-related communications, appointment reminders, and responses to your inquiries. Message and data rates may apply. Reply STOP to opt out at any time.

9. Accuracy of Information

You agree to provide truthful, accurate, and complete information at all times. Providing false or misleading medical history, identity information, or other material facts may result in immediate termination of services and may expose you to legal liability.

10. Limitation of Liability

To the fullest extent permitted by law, The Performance Institute, its physicians, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our services. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

Nothing in this section limits liability for gross negligence, willful misconduct, or as otherwise prohibited by law.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Georgia.

Patients located in Texas and Tennessee at the time of service acknowledge that telehealth services are subject to the telehealth laws and regulations of their respective states. Dr. Michael is licensed to practice medicine and provide telehealth services in Georgia, Texas, and Tennessee. Your use of our services from any of these states constitutes your agreement to comply with the applicable telehealth regulations of your state.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. Continued use of our services after any changes constitutes acceptance of the updated terms. We will update the "Last updated" date at the top of this page when changes are made.
